Procedure to Grant License

Eating houses registered in the following categories:

• You’re eating house provides food to customer and there is a dancing facility also (regardless of the number of days it is provided).
• You provide dance floor with the facility of live rock / DJ band in your licensed eating house to your customers.

If you fall in any of the above two Categories, you need to have

• A Regulation 190 license to sell tickets in case there is an entry ticket for your eating house.
• A Regulation 116 yearlong performance license to hold activities for public amusement.
• A Regulation 107 premise license from the Regulations for Licensing and Controlling Places for Public Amusement (apart from Cinemas) to open a place which is intended for public amusement.

How to Obtain the License?

You are required to submit the following documents:

Step 1

The procedure to obtain a Premise License is given below – the applicant should bring along the following documents

• Application/request letter on a plain paper.
• Ownership proof (Photocopy of the registry/power of attorney/NOC/deed papers countersigned by the concerned authority and issued by the DDA).
• Photocopy of the valid trade license, eating house license, fire NOC etc – along with these documents details of the eating house license.
• If the eating house and the discotheque are in the same premises, you should also carry the following documents:
• Site plan along with the dimensions of the open space/dance floor and 4 photographs taken from different angles.
• Copies of the electricity bills/NOC of the electrical inspector.
• NOC of fire.
• If the eating house and the discotheque are in different premises then – four copies of the site plan in blue print, four passport size colour photograph of the premises proposed, and capacity of the discotheque along with its dimensions.
• Affidavit.

Step 2

Once the above mentioned documents have submitted, the licensing unit goes through the following procedure:

No objection reports are taken from:

• Entertainment tax officer
• Electrical inspector
• Chief fire officer
• Traffic police
• From law and order point of view, report from local police. And the antecedent and character report, if the person who has the eating house license is different from the applicant.

Step 3

Discotheque license is granted once all the NOCs are obtained.

Renewal

You should apply for renewal at least one month before the expiry of the discotheque license and following documents are required at the time of renewal:

• Request on a plain paper/application from the applicant.
• NOC issued from electrical department.
• NOC issued from fire department.
• Medical fitness of the working staff.
• Health trade license from DCB / NDMC / MCD for the current year.
• List of employees working in the discotheque.
• Applicant should also submit an affidavit on non-judicial stamp paper with Rs. 10 and Rs. 5 as judicial stamp duty along with self-attested photograph and attested by the Notary.
