Video Game Parlour




Procedure

A license from a Licensing unit needs to be applied for by any person who wants to open and run a Video Game Parlour. Under the “Regulations for Licensing and Controlling Places of Public Amusement (Other than Cinemas) and Performances of Public Amusement (Amendment) Act”, 1991, the license for Video Game Parlour is granted.

  • Step 1

Documents Needed

  • Application on prescribed form for the granting No Objection Certificate (04 sets).Click to Download
  • Four post card sized photographs of Video Game Parlour clicked from different angles.
  • Four sets of Site Plan that has been approved by competent authority. Along with the size and location of Video game parlour, the site plan drawn to scale must also include video game machines, surrounding roads and buildings (like schools, place of worship, hospitals or petrol pump) upto 75 meters of the proposed site. The plans must also clearly indicate the overhead high tension cables.
  • Ownership proof – N.O.C from landlord, Receipt of rent, lease agreement, Photocopy of the power of attorney or registry.
  • Three duly attested (by GO on backside) passport size photographs of applicant.
  • Proof residence of the applicant – like attested photocopy of the Ration card, Electoral card etc.
  • Applicant needs to submit an Affidavit on non-judicial stamp worth Rs.10 /- and judicial stamp worth Rs.5/- duly attested by Notary Public along with self attested photographs. Click to Download.
  • Step 2
  • After obtaining the mentioned documents, a notice on Form B Click to Download is sent to the local police authorities to invite any objections for pasting a major place of the shop and for making D.D entry for the same. The local police solicit a report as well.
  • Chief Fire Officer provides a report.
  • The electrical inspector submits a report.
  • Other inquiries deemed necessary by the Licensing unit are also made.
  • Step 3

License to run a Video game parlour on proposed premises is granted once all N.O.C's are obtained.

Renewal of License

License that is granted is valid up to 31st December of that year and hence, it needs to be renewed. The following documents need to be submitted at the time of renewal.

  • An Affidavit Click to Download is needed to be submitted.
  • The affidavit is then sent to the local police for verification.
  • After verification report and payment of fees is receives, the license is renewed.

Show Cause Notice

The Licensing authority may refuse to renew the license after issuing as show cause notice to the applicant or license. This can be done if the licensee is found to violate any conditions of the License or if the licensing authority is satisfied that granting the license could cause inconvenience, annoyance or obstruction or put to danger the residents or passenger in the vicinity of the video game parlour. This can also be done if the owner/ organizer/ manager of the video game parlour is deemed unfit by the authorities or the premises are likely to be used for illegal or antisocial activities. The show cause notice is issued only after it has been approved by the Additional C.P, Licensing.

As per the order of the Commissioner Of Police under section 144 of the Criminal Procedure Code , 1973 the strict compliance of the following is to be done, in case your video game parlour provides cyber café facilities as well –

  • The use of Cyber café by unknown persons whose identity has not been established by the café owner is prohibited.
  • A register needs to be maintained for the identity of user/visitor.
  • The identity proof, name, address and telephone number of visitor is to be entered in the visitor/user’s identity. The register also needs to be signed by visitor.
  • User needs to establish his/her identity through any of the following: ration card, identity card, driving license, voter card, ration card, driving license, passport and photo identity card.
  • The activity server log is to be preserved in the main server for at least six months.
  • The cyber café owner will immediately inform local police if the activity of any user is suspicious; and
  • The record of specific computer used by the person should be maintained.
