Relocation




There are a number of Jhuggi Jhopri or JJ areas in Delhi. These areas can also be referred to as squatter colonies or slum areas. The living conditions of these areas are extremely poor with unhygienic condition and low standard of living. Hence, to better the conditions of these areas and to provide the residents with a better life, both Government and the Department in charge of these areas have formed a three pronged approach, adopted as early as 1990-1991. They are as follows:

  1. In case of a land occupied by people are to be taken up for any infrastructure projects, then the occupants will be relocated by the Dept, if they were residing in the said area before 31 January, 1990. Upon further revising of this rule, it has now been decided that those families possessing ration cards of the above mentioned dated will be given plots measuring 18 sq.ms. A plot measuring 18 sq.ms will be given to those ration cards are after 1990s. Even those having ration cards of December 1998 were given 12.5 sq.ms land.
  2. If the land is not need by the owner agencies in the near future, then NOC has to be given for the developing of these clusters.
  3. For those clusters which do not fall in the above two categories, civic services will be provided in these areas.
  4. It was also decided that there has to be constant efforts to better the living conditions of people in these areas and hence there has been quite a number of schemes aimed at employment, education, sanitation facilities and for children. One such scheme is the Jansuvidha Complex where pay and use toilets are constructed so that the dwellers do not have to defecate in the open inviting and spreading diseases. There are Shishu Vatikas which ensure that there are open spaces for children of these areas to play and study. The Basti Vikas Kendra ensures that the social spending needs of the residents are met.

Eligibility Conditions

  1. Only those dwellers who are citizens of India and have completed 18 years of age will be considered.
  2. The family has to fulfil the criteria spelt out as per the Government of India’s Basic Services to Urban Poor. And this criteria deals with the annual income of the family which should not exceed Rs. 60000.
  3. It has also to be noted by the JJ dweller that they will not be granted the allocation of flat as a right.
  4. DUSIB conducts a bio-metric survey along with the owner agency of the land from time to time. Only those who are listed in this survey will be the beneficiaries of this scheme. A committee comprising the Assistant Electoral Registration Officer, Tehsildar, Deputy Director (SUR) and Food Supply officer is formed. An officer from the land owning agency is also a part of this committee. It is this committee that approves the eligibility list. This list is based on the survey by DUSIB and all the documents are verified as per the survey.
  5. It is often noted that one person occupies more than one jhuggies in the area but even in such a case, he will get only one residential flat and not as many jhuggies he occupies.
  6. The flats allocated are for residential purposes and they cannot be used for any commercial purpose or any other purpose other than staying.
  7. In jhuggies, it is found that a plot is used for both residential and commercial purposes. The ground floor might be let out for any commercial activity such as godowns or shops and the upper floor for residential purpose. In some other case, a person might be having two spaces, one for living and other for any commercial activity. In either case, these two purposes will not be considered and the occupant will be eligible for only one residential flat.
  8. In cases where there are two families or persons occupying the ground floor and the upper storey of a jhuggie, it is to be noted that the beneficiary will only be the one who occupies the ground floor.
  9. If the occupant of a jhuggie is husband-wife duo, then the allotment of the flat will be in the joint-name of both and not just one. The Slum & JJ Department maintains the records of the occupants and that includes bio-metrics and photos of them and also other family members.
  10. The date 31 December, 1998 has to be noted by the jhuggie occupants for being eligible for flats under relocation. One this is the date on which they have to be in the voters’ list and their ration card must be before this date.
  11. There has been several cases regarding relocation pending in various courts as of now and one that is pending with Supreme Court is the SLP (Civil No. 3166-3167/2003). The policy regarding flat allocation will change as per the outcome of these cases.
  12. If the dweller who had been listed in the survey as the occupant of a particular jhuggie dies after the survey, the flat will be allotted to the legal heirs, especially the widow or the widower of the dweller. Of course, they will have to fulfil all and any eligibility conditions.
